General Terms and Conditions for Events at the Quadriga Campus Conference and Convention Center

I. Scope of application
1 These terms and conditions apply to contracts for the rental of conference, banquet and event rooms of the Conference and Convention Center to an organizer for the holding of events such as seminars, conferences, exhibitions and presentations, etc., as well as to all other related services and deliveries of the Quadriga Campus Conference and Convention Center.
2. the subletting or re-letting of the rooms and areas provided, as well as invitations to job interviews, sales or similar events, require the prior written consent of the Quadriga Campus Conference and Convention Center.
3. the organizer's general terms and conditions shall only apply if this has been expressly agreed between the parties.
II Conclusion of contract, partners, liability
1. the contract is concluded when Quadriga Media Berlin GmbH accepts the application (confirmation) from the organizer; these are the contractual partners.
2. if the customer/purchaser is not the organizer himself or if a commercial agent or organizer is engaged by the organizer, the latter shall be jointly and severally liable with the organizer for all obligations arising from the contract.
3 Quadriga Campus Konferenz- und Tagungszentrum is liable for its obligations under the contract. This liability is limited to deficiencies in performance that are attributable to intent or gross negligence on the part of the Quadriga Campus Conference and Convention Center, except in the area of typical performance. Furthermore, the organizer is obliged to inform Quadriga Campus Konferenz- und Tagungszentrum in good time of the possibility of exceptionally high damages. The limitation of liability does not apply to personal injury.
III Services, prices, payment, offsetting
1 Quadriga Campus Konferenz- und Tagungszentrum is obliged to provide the services ordered by the customer and promised by Quadriga Campus Konferenz- und Tagungszentrum.
2 The customer is obliged to pay the agreed prices of Quadriga Campus Konferenz- und Tagungszentrum for these and other services used. If additional services are used without a separate agreement, the prices in the current price list apply, otherwise the appropriate remuneration. This also applies to services and expenses of the conference and convention center to third parties arranged by the customer, in particular for claims by copyright collecting societies (e.g. Gema).
3. if the period between conclusion and fulfillment of the contract exceeds 4 months and the price generally charged by Quadriga Campus Konferenz- und Tagungszentrum for services agreed between the contracting parties changes, the contractually agreed price may be adjusted, but not increased by more than 10 %. The agreed net prices are subject to the statutory value added tax applicable at the time of the event.
4. invoices of the Quadriga Campus Conference and Convention Center without a due date are payable in full within 30 days of receipt of the invoice. In the event of late payment, the Quadriga Campus Conference and Congress Center is entitled to charge the applicable statutory default interest of currently 8 percentage points above the base interest rate or, in the case of legal transactions involving a consumer, 5 percentage points above the base interest rate. Quadriga Campus Konferenz- und Tagungszentrum reserves the right to provide evidence of higher damages. The organizer reserves the right to provide evidence of lower damages.
5. the conference and convention center is entitled to demand an appropriate advance payment or security deposit from the organizer in the form of a credit card guarantee or a cash deposit upon conclusion of the contract.
6. in justified cases, e.g. payment arrears of the organizer or extension of the scope of the contract, Quadriga Campus Konferenz- und Tagungszentrum is entitled to demand an advance payment or security deposit or an increase of the advance payment or security deposit agreed in the contract up to the full agreed remuneration, even after conclusion of the contract up to the start of the event.
7. the organizer may only offset or reduce a claim of the conference and convention center with an undisputed or legally binding claim or exercise a right of retention.
8 Quadriga Campus Konferenz- und Tagungszentrum will not cover travel and accommodation costs or expenses incurred due to loss of working hours in the event of loss of rental space or postponement of the event.
9. software installations and hardware solutions that deviate from our standard installations are subject to a charge. The prices of Quadriga Media Berlin GmbH apply, which are based on the current price list.
IV Cancellation and withdrawal by the organizer
1 Cancellation by the organizer is possible free of charge up to 90 days before the start of the event. Cancellation must be declared in writing. If a cancellation is made on or after the 90th day before the start of the event, the following portions of the agreed total price shall be paid by the organizer: 90 to 41 days before the start of the event: 20% 40 to 21 days before the start of the event: 60% 20 to 8 days before the start of the event: 80% 7 to 3 days before the start of the event: 90% thereafter: 100 %
2. the organizer reserves the right to reduce this amount if he can prove that Quadriga Campus Konferenz- und Tagungszentrum has suffered less damage.
3. the organizer's right to withdraw from the contract within the framework of the legally regulated disruption of performance remains unaffected.
V. Withdrawal or termination by Quadriga Campus Konferenz- und Tagungszentrum
1 Quadriga Campus Konferenz- und Tagungszentrum is entitled to withdraw from the contract if the advance payment is not made even after the expiry of a reasonable grace period set by Quadriga Campus Konferenz- und Tagungszentrum with a threat of refusal by the organizer.
2. furthermore, Quadriga Campus Konferenz- und Tagungszentrum is entitled to extraordinary termination of the contract without notice for good cause. This is deemed to be the case in particular if
- force majeure or other circumstances for which the conference and convention center is not responsible make it impossible to fulfill the contract;
- events were booked under misleading or false statements of material facts, e.g. the identity of the organizer or the purpose of the event;
- the conference and convention center has reasonable grounds to believe that the event may jeopardize the smooth operation of the business, safety or security of the conference and convention center.
can endanger the reputation of the conference and convention center in public without this being attributable to the sphere of control or organization of the conference and convention center;
- the premises are made available to a third party by the organizer without the consent of Quadriga Campus Konferenz- und Tagungszentrum.
3. in the event of justified withdrawal by Quadriga Campus Konferenz- und Tagungszentrum, the organizer shall have no claim to compensation. Services received are to be returned. Quadriga Campus Konferenz- und Tagungszentrum's right to compensation for damages and expenses remains unaffected. Should Quadriga Campus Konferenz- und Tagungszentrum make use of its right of withdrawal, it must inform the organizer of this immediately.
VI Changes to the event room, the number of participants and the event time
1. the organizer is not entitled to a specific room in the Quadriga Campus Conference and Convention Center. Quadriga Campus Konferenz- und Tagungszentrum reserves the right to change the planned room at any time before the start of the event according to availability and to provide an adequate replacement if it informs the organizer of this immediately. Anything to the contrary shall only apply if this has been expressly agreed, the new room is not suitable for the agreed use or a change is unreasonable for the organizer for other reasons. In particular, it is considered reasonable if the organizer has announced a specific room to its guests, but Quadriga Campus Konferenz- und Tagungszentrum provides clarifying signage on site after a room change.
2. the Conference and Convention Center must be notified of any changes to the agreed number of participants no later than 4 weeks before the start of the event; this requires the written consent of the Quadriga Campus Conference and Convention Center. Subsequent reductions in the number of participants shall not be taken into account in the calculation. The customer is at liberty to reduce the agreed price by the actual expenses saved by the conference and meeting center due to the lower number of participants. The customer shall bear the burden of presentation and proof in this respect.
3. if the number of participants is higher, the actual number of participants will be charged.
4. if the agreed start or end times of the event are postponed and the conference and convention center agrees to these deviations, the conference and convention center may reasonably adjust the additional readiness to perform in
The Quadriga Campus Konferenz- und Tagungszentrum is at fault.
5 If a flat rate for participants has been agreed, a reduction in the number of participants may result in a recalculation of the flat rate with an updated allocation of the room rental.
VII Bringing food and beverages; smoking ban; beverage flat rates
1 The organizer may not bring food and drinks to events. Exceptions require a written agreement with the Quadriga Campus Conference and Convention Center. In such cases, a contribution will be charged to cover overhead costs.
2 Smoking is strictly prohibited in the entire interior of the Quadriga Campus Conference and Convention Center. The organizer is liable for compliance with this by its event participants or visitors, employees, vicarious agents or contractual partners. In the event of non-compliance, the parties agree on a contractual penalty of € 100 plus VAT to be borne by the organizer. The parties are at liberty to prove higher or lower costs in individual cases, e.g. for cleaning or damage.
3. beverage flat rates include the supply of participants on site in the usual quantities and to the extent of the agreed beverage selection. Quadriga Campus Konferenz- und Tagungszentrum reserves the right to charge an additional fee in accordance with the currently valid price list for beverage consumption in excess of this or if beverages are brought along.
VIII Technical facilities and connections, other services
1. to the extent that Quadriga Campus Konferenz- und Tagungszentrum procures services or goods (e.g. event technology) from third parties for the organizer at the organizer's request, it acts in the name of, on behalf of and for the account of the organizer. In the event of any changes and/or cancelations, the conditions of the third-party provider shall apply to this part of the event.
2 The organizer is liable for the careful handling and proper return of the equipment. The organizer shall indemnify the Quadriga Campus Conference and Convention Center against all third-party claims arising from the provision of these facilities.
3. the use of the organizer's own electrical equipment using the Quadriga Campus Konferenz- und Tagungszentrum's power grid requires the organizer's written consent. Any malfunctions or damage to the technical equipment of the Quadriga Campus Conference and Convention Center resulting from the use of such equipment shall be borne by the organizer. The electricity costs arising from the use may be recorded and charged at a flat rate by the Quadriga Campus Conference and Meeting Center.
4. with the consent of Quadriga Campus Konferenz- und Tagungszentrum, the organizer is entitled to use its own telephone, fax and data transmission equipment. Quadriga Campus Konferenz- und Tagungszentrum may charge a connection fee for this.
5. if previously rented Quadriga Campus Konferenz- und Tagungszentrum facilities remain unused due to the connection of the organizer's own facilities, a cancellation fee may be charged.
6. faults in technical or other equipment provided by the Quadriga Campus Conference and Convention Center will be rectified immediately if possible. Payments may not be withheld or reduced insofar as the Quadriga Campus Conference and Convention Center is not responsible for these disruptions.
IX. Loss of or damage to items brought onto the premises
1. exhibits or other items, including personal items, are kept in the event rooms or in the Quadriga Campus Conference and Convention Center at the risk of the organizer. Quadriga Campus Konferenz- und Tagungszentrum accepts no liability for loss, destruction or damage, including financial loss, except in cases of gross negligence or intent on the part of Quadriga Campus Konferenz- und Tagungszentrum. Excluded from this are damages resulting from injury to life, limb or health. In addition, all cases in which safekeeping is a typical contractual obligation due to the circumstances of the individual case are excluded from this exemption from liability.
2. decoration material brought along must comply with fire protection requirements. The Quadriga Campus Conference and Convention Center is entitled to demand official proof of this. If such proof is not provided, the Quadriga Campus Conference and Convention Center is entitled to remove any material already brought in at the customer's expense. Due to possible damage, the installation and attachment of objects must be agreed in advance with the Quadriga Campus Conference and Meeting Center.
3. exhibits or other items brought onto the premises must be removed immediately after the end of the event. If the organizer fails to do so, the conference and convention center may remove and store the items at the organizer's expense. If the items remain in the event room, the Quadriga Campus Conference and Convention Center may charge a reasonable expense allowance for storage for the duration of their retention.
X. Liability of the organizer for damages
1. the organizer is liable for all damage to buildings or inventory caused by him, his event participants or visitors, employees, vicarious agents, contractual partners or other third parties from his area or caused.
2 Quadriga Campus Konferenz- und Tagungszentrum may require the customer to provide appropriate security (e.g. insurance, deposits, guarantees).
IX. Final provisions
1. place of performance and payment is Berlin.
2. place of jurisdiction in commercial transactions and if the requirements of § 38 para. 2 ZPO are met is Berlin. German law shall apply. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
(3) Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
